By purchasing a plan or using our services, you agree to these Terms and Conditions. Please read them carefully before placing an order.
1. Our Services
1.1. Digital Album Creation
SpecialAlbum.com provides personalised digital albums for weddings and other special events. Our team uses the photos, stories, event details, and other information you submit to create your album.
1.2. Human-Created Albums
Our albums are personally designed and created by our team. The final design may vary depending on your submitted materials, selected template, and the creative decisions needed to produce your album.
1.3. Hosting Plans
We offer different hosting plans, including 3-year, 5-year, 10-year, and Lifetime plans. The hosting duration, photo limits, revision allowances, and other benefits applicable to your purchase will be specified on our pricing page or at checkout.
2. Orders and Payments
2.1. Placing an Order
To purchase a plan, you must provide the information required during checkout and pay the applicable price.
2.2. Order Confirmation
Your order is considered submitted once your purchase has been completed and payment has been confirmed.
2.3. Submitting Album Details
After purchasing a plan, you must submit the photos, event details, stories, and other information required to create your album through the submission form available in your dashboard.
2.4. Accuracy of Information
You are responsible for ensuring that the information and materials you submit are accurate, complete, and suitable for creating your album.
2.5. Incomplete Submissions
Our album creation process begins once we have received all the required information and materials. Incomplete submissions may delay the creation and delivery of your album.
3. Customer Responsibilities and Content Restrictions
3.1. Your Submitted Materials
You are responsible for ensuring that you have the necessary rights and permissions to submit all photos, videos, stories, voice recordings, and other materials you provide to SpecialAlbum.com.
You must not submit materials that infringe another person’s copyright, privacy, or other legal rights.
3.2. Prohibited Content
SpecialAlbum.com reserves the right to refuse, suspend, or cancel an order if the submitted materials or requested album contain:
- Pornographic or sexually explicit content.
- Abusive, threatening, or harassing content.
- Illegal content or materials that promote unlawful activities.
- Content that infringes another person’s intellectual property, privacy, or other rights.
- Content intended to harm, threaten, or target a person or community.
- Content that promotes hatred, discrimination, or violence based on characteristics such as religion, race, colour, gender, or other protected or personal characteristics.
- Content that targets or promotes harm against a particular community, location, or group of people.
We may review submitted materials to determine whether they comply with these restrictions.
3.3. Refusal of Service
If we determine that your requested album violates these Terms and Conditions or cannot be created in accordance with our content restrictions, we may refuse to create the album.
If we are unable to create your requested album, refund eligibility will be determined in accordance with our Refund Policy.
4. Rights to Your Photos and Content
4.1. Ownership
You retain ownership of the photos, stories, and other materials you submit to SpecialAlbum.com. You do not transfer ownership of your original materials to us by purchasing our services.
4.2. Permission to Create Your Album
By submitting your materials, you grant SpecialAlbum.com permission to download, resize, edit, arrange, store, and display those materials as reasonably necessary to create, publish, host, and deliver your personalised digital album.
This permission is limited to providing the services you have purchased.
4.3. Promotional Use
We may request your optional permission to use selected photos or your album for promotional purposes, such as on our website or social media.
We will only use your album or photos for promotional purposes if you have provided the required consent through the optional promotional consent checkbox.
Agreeing to promotional use is not required to purchase a plan or have your album created.
5. Album Design, Revisions, and Delivery
5.1. Album Design
Our team will create your album based on the information and materials you submit, along with the template and plan you select.
We aim to deliver an album that reflects your event and preferences. However, the final design may differ from your expectations because of the creative decisions required to produce the album.
5.2. Included Revisions
Each plan includes a specified number of revisions. The revision allowance applicable to your purchase will be displayed on our pricing page or at checkout.
Revisions must relate to the album originally requested. Changes that require substantial additional work or fall outside your included revision allowance may incur additional charges, which will be communicated to you before the additional work begins.
5.3. Delivery Time
Our estimated delivery time is generally 1–2 days after we receive all required photos, event details, and other information needed to create your album.
This is an estimated timeframe and may be affected by incomplete submissions, requests for changes, technical issues, or circumstances beyond our reasonable control.
5.4. Customer Review
You should review your album after receiving it and contact our support team if you identify an issue or require a revision within your plan’s allowance.
6. Album Hosting and Renewal
6.1. Hosting Duration
Your album will be hosted for the duration included in your purchased plan:
- 3-year plan: 3 years.
- 5-year plan: 5 years.
- 10-year plan: 10 years.
- Lifetime plan: Lifetime hosting, with no renewal required.
The hosting period begins on the date your album is published.
6.2. Renewal Reminders
For plans with a limited hosting duration, we will send renewal reminders to your registered email address:
- One month before the hosting period expires.
- One week before the hosting period expires.
- One day before the hosting period expires.
Each reminder will include the renewal link and applicable renewal fee.
6.3. Renewal Fee
The renewal fee will be 50% of the current standard price of the applicable plan at the time of renewal.
For example, if the current standard price of the applicable 5-year plan is $60, the renewal fee will be $30.
Renewing your plan provides another hosting period of the same duration as your original plan.
6.4. Expiry Without Renewal
If your hosting period expires without renewal:
- Your album will be made private and will no longer be publicly accessible through its album link.
- We will retain your album content for a maximum of one month after the hosting expiry date.
- If you renew during this one-month retention period, we may be able to restore your existing album.
- If you do not renew within the retention period, your album content will be permanently deleted from our servers.
6.5. After Permanent Deletion
Once your album content has been permanently deleted, we may no longer be able to restore your original album.
If you wish to have an album recreated after permanent deletion, you will need to place a new order at the full current price of your chosen plan and submit the required materials again.
6.6. Lifetime Hosting
Lifetime plans do not require renewal. Your album will remain hosted for as long as SpecialAlbum.com continues to operate, subject to these Terms and Conditions.
7. Plan Upgrades
7.1. Requesting an Upgrade
If you wish to upgrade to a longer hosting plan, please contact our customer support team by email.
Our team will review your request and provide a personalised payment link for the upgrade.
7.2. Upgrade Charges
The upgrade charge will be calculated based on the applicable price difference between your existing plan and your desired plan.
For example, if you purchased a 3-year plan for $29 and wish to upgrade to a Lifetime plan priced at $89, the upgrade charge would be $60.
Your upgrade will be processed manually by our team once the applicable payment has been completed.
8. Refund Policy
Refund requests are handled according to our published Refund Policy.
The refund percentage available to you depends on the status of your album, the amount of work completed, and the applicable time period.
Please review our Refund Policy before purchasing a plan.
9. Privacy and Data Handling
Your personal information and submitted album materials are handled in accordance with our Privacy Policy.
By using our services, you acknowledge that we need to collect and process the information you submit to create, host, and deliver your album.
Our Privacy Policy explains how your information is stored, used, and deleted, including the retention of order and accounting records.
10. Availability of Our Services
10.1. Service Availability
We make reasonable efforts to keep our website and hosted albums available. However, temporary interruptions may occur because of maintenance, technical problems, or circumstances beyond our reasonable control.
10.2. Technical Issues
We are not responsible for temporary service interruptions caused by third-party infrastructure, hosting providers, internet connectivity, or other technical circumstances beyond our reasonable control.
10.3. Changes to Services
We may update or modify our services, website features, album templates, or technical infrastructure as needed to maintain and improve our business.
We will make reasonable efforts to avoid disrupting existing hosted albums when making such changes.
11. Limitation of Liability
To the extent permitted by applicable law, SpecialAlbum.com will not be liable for indirect or consequential losses arising from the use of our services, temporary service interruptions, or circumstances beyond our reasonable control.
Nothing in these Terms and Conditions excludes or limits any liability that cannot legally be excluded or limited under applicable law.
12. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, business practices, or legal requirements.
Any updated version will be published on this page with a revised Last Updated date.
13. Governing Law and Disputes
